Child custody issues can be highly contentious. A custody battle currently in the news is no exception. The case is particularly complicated because four-and-a-half years have passed since the court battle began and the child in question has now been living with his current parent for six years.
A 33-year-old woman is suing for custody of her six-year-old son who she allegedly gave up for adoption after the boy was born in Texas. At the time she was unable to provide for the baby. The man who she gave the boy to is a family friend who she was never married to. He is not the biological father and a legal adoption never took place. Instead, the man’s name was listed on the birth certificate as the child’s father.
According to the report, just 15 months after telling the man and his wife that they could have the baby, the biological mother changed her mind. By this time the man and his wife had grown attached to the child and were unwilling to give him up.
The child’s biological mother sued for custody and claims that the man took the child from her. She said she did not agree to listing the man as the child’s father on the birth certificate and that it was placed there while she was still under the effects of anesthesia. The court battle has lasted for four-and-a-half years.
The case brings up an interesting question. What is in the best interest of the child? To stay in the only home he has ever known? Would he be better off living with his biological mother? Can the two come up with a shared custody agreement? Only time will tell. For now, it does not appear that a final decision will be made anytime soon.
